Terms & Conditions

giving2children is a global crowdfunding platform managed by Childhood Cancer International (CCI), a non-profit organisation, with legal entity registered under the number 855025177, in The Netherlands, at the address Kraijenhoffstraat 137A, 1018RG, Amsterdam. We are a registered charity at the Dutch Chamber of Commerce, under the registration number: 62945432. Our website is www.childhoodcancerinternational.org.

If you are a user (Member Organisation, Donor, Visitor – as defined below) located anywhere in the world, by using the services of the giving2children (the “Platform”) you are contracting with the Childhood Cancer International.

Definitions

Within the framework of the giving2children, a Member Organisation is a CCI member organisation with a profile created on the Platform, which has active fundraising project(s) launched on the Platform, or planning to have sooner or later.

Within the framework of the giving2children, a Donor is any individual, company or organisation who engages in the donation process by contributing to any of the fundraising projects published on the Platform.

Within the framework of the giving2children, a Visitor is any individual or representative of a company or organisation who explores the Platform, with or without engaging in a donation process or in signing up as a Member Organisation.

For purposes of these Terms & Conditions, “giving2children”, “the Platform”, “we”, “us”, “our” and other similar terms, shall refer to the party with whom you are contracting.

By using giving2children, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

Access and Use of Services

Description of services

The services are offered as a crowdfunding platform to allow a non-profit organisation (the “Member Organisation”) member of Childhood Cancer International to post a campaign (“Project”) to the Platform to accept monetary donations (“Donations”) from donors (“Donors”). If you are under 13 years of age (16 in the European Economic Area), you are not authorised to use the Services. In addition, if you are under the age of majority in your jurisdiction (typically 18 or 19 years of age), you may use the Services, with or without registering, only with the approval of your parent or guardian.

Projects

We understand a “Project” as being a fundraising campaign published on the giving2children crowdfunding platform, after a vetting process of the project application form and approval received from CCI, the party in charge of the giving2children.

Two types of projects are available on the platform: all-or-nothing or flexible. All-or-nothing is a type of funding through which the Member Organisation sets a funding goal that must be met in order to allow the project to be implemented at its full potential. If the funding goal is not met, the money is refunded to each Donor. The refund process is managed through third-parties, Stripe and PayPal, as mentioned in these Terms & Conditions. A flexible project refers to the type of funding through which the Member Organisation sets a funding goal and even if it is not met, the money is still received by the Member Organisation, as the type of project allows it to reach its impact even if the funding goal is not reached.

Payment Processor

giving2children uses third-party payment processors (Stripe and PayPal) for donations, as the Platform is not a payment processor. By using the Platform, you acknowledge and agree that Stripe and PayPal are services integrated to the Platform, and that we may exchange information with them as third parties in order to facilitate the provision of the services.

Stripe and PayPal Transaction Fee

As transactions are processed through third-parties, the transaction fees of Stripe and PayPal are retained from each donation consisting of an average of 5% per donation.

Chargebacks and Refunds

If a Donor disputes a credit card transaction for a Donation through giving2children or requests a refund, the Donations are refunded through PayPal and Stripe in a maximum of 90 days since the donation is made, depending on the payment processor used at the time of making the donation. Platform Maintenance Costs

giving2children does not require any fee to post a Project for fundraising on the Platform. However, the Platform through CCI retains 10% of each donation. This percentage is used to ensure the self-sustainability of the Platform, by covering administrative costs (subscriptions to third parties such as mailing list, servers, domain, hosting etc), management (the support team), marketing and promotion (services provided by a third party), web maintenance and further development related to the web application and WordPress, and miscellaneous.

No Direct Communication

The Platform is offered to help Member Organisations connect with Donors, however through giving2children the Member Organisations do not engage directly with Donors, neither the Donors with the Member Organisations. The Member Organisations do not have access to any information related to the Donors, while the Donors have access to contact details of the Member Organisation, as published on the web page dedicated to each Project. If the Donor decides to engage in communication with a Member Organisation, outside of the Services provided by The Platform, it will be their sole responsibility and giving2children and CCI do not take any accountability.

Indirect Communication

Through the Services offered by the Platform, the Member Organisations communicate indirectly with the Donors by sharing their organisation’s data, Project information when launching a campaign, as well as intermediate and final Project implementation updates. This is managed by giving2children through the Platform web pages, dedicated project pages, blog posts, newsletters, and social media posts.

Donors

When you make a Donation through the Platform, it is your responsibility to understand how your money will be used and to check the Member Organisation content regularly for any updates. It is your responsibility as a Donor to note if a project is flexible or all-or-nothing, and to determine if any taxes apply to your Donations. giving2children only promotes Projects of CCI member organisations, which go through a vetting process. The Member Organisations submit projects and they might be approved or rejected, followed by specific feedback. This process offers more security, transparency and credibility regarding the Member Organisations profile and capacity to implement the Project as intended. Once the Donations are transferred to the Member Organisation, we request updates regarding the project implementation. Upon completion of the project, we request a report, including media proofs and testimonials. This approach reduces the risks for the Donor and consolidates the credibility of the Platform, however we cannot verify fully all data provided by the Member Organisation, nor represent or guarantee that the Donations are used completely and exclusively in accordance with the fundraising purpose. We do take possible fraudulent activity very seriously, therefore if you have a reason to believe that a User is engaged in fraudulent activity, please contact the support team at [email protected].

Donation Process

To proceed with a Donation, a Donor is required to provide information related to their credit card as requested by Stripe and PayPal. The Donor has the obligation to ensure that the information is accurate and they have the authority to make such payments. As a Donor, you agree to the processing, use, transfer, and disclosure of data to and by the Payment Processors (Stripe and PayPal) as mentioned in these Terms & Conditions, and in the terms set by the third-parties. You agree that a minimum Donation can apply, and the refund is processed only with a prior refund request, and with the approval of giving2children, as mentioned in these Terms & Conditions.

Tax Deduction

Tax deductions can be provided for Donations offered to a Member Organisation located in the same country as the Donor. If you are a Donor, and you wish to receive support for Tax Deduction, please note that this is possible only for Donations made for Member Organisations registered in your own country. If you donate to a Project of a Member Organisation from a different country, giving2children cannot provide support with tax deduction. If you are a Member Organisation, you have the obligation to provide tax deduction support, as per the guidance of CCI, without having direct contact with the Donor, unless specifically advised otherwise by CCI with written proof.

Member Organisations

You, as a Member Organisation, represent, warrant and covenant that all information provided in relation to the organisation you represent or through the Project(s) published on the Platform is accurate, complete and is not likely to deceive Users. You acknowledge that you will post updates and provide a final report to support Donors and giving2children to understand and showcase the use of the funds as per the purpose of the project. You acknowledge and agree that all Donations will be used for the purpose of the fundraising campaign, and you will share with us the relevant data and will allow us to use this data for the purposes for which it was shared with us.

Donation Transfer to the Member Organisation

The Donations are made through PayPal and Stripe, and once a Project is concluded, we issue a Statement of Donations, through which is stated clearly the amount fundraised for the Project, it is calculated the value of the Payment Processors Fees (5%), and of the Platform Maintenance Costs (10%). The Statement is sent by email to the person in charge of the Project on behalf of the Member Organisation, together with the template of Call for Funds. Upon receiving the Statement, the Member Organisation submits a Call for Funds – the official document through which the Member Organisation requests to receive the Donations. Once the Call for Funds is received, the bank transfer is made into the bank account indicated by the Member Organisation, with the bank fees being supported by the Member Organisation.

Removal of a Member Organisation from the Platform

If a Member Organisation wishes to withdraw from the Platform and remove the account, this will be done through an official letter submitted by the Chairperson or Senior Manager of the Member Organisation, and sent by email at [email protected]. Once this request is approved, the account will be removed from the Platform. We reserve the right to store the data associated with the account (profile information, Project(s) information etc) for 5 years after the removal, for reporting, audit and assessment purposes.

Removal of a Donor from the Database and Other Data

A Donor, individual or company, may provide information such as name, email address, Donation amount, date of transaction, transaction identification number, name of the project, etc. The list of Donors and this data is stored in databases of third-parties, such as (but not exclusively): Stripe and PayPal for Services related to the payment of Donation, and Mailchimp for Services related to newsletters and other emails. Even if a Donor chooses to remain “Anonymous” at the time of Donation, the Donor acknowledges and agrees to the use of their personal data as described herein, including, without limitation, disclosure as part of a Donor List. This data is stored as per the Privacy Policy. The Donor can choose to opt-out from the newsletter at any point, through the “unsubscribe” button.

reCAPTCHA

The Platform uses the reCAPTCHA product to provide an added level of security. reCAPTCHA is subject to the Google Privacy Policy and Terms and Conditions.

Google Maps

The Platform uses the Google Maps feature and content, which is subject to the then-current versions of the Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy.

Code of Conduct

As a User of the Platform, you acknowledge and agree to respect and comply with the following Code of Conduct:

  • giving2children cannot be used to raise funds for or contribute to any Project that promotes or involves:
  • violation of laws and regulations, or guidelines and agreements, including related to the payment processors used for the Services;
  • fraud, misleading actions, and dishonesty;
  • offensive, sensitive, or sexual content;
  • funding of human trafficking or exploitation, terrorism, bribes, or other similar crimes;
  • activities that are subject to sanctions under applicable law;
  • collection of funds owed to third-parties, including loans, deposits, or investments, or hidden purposes;
  • attempts to bypass the designated method of payment as provided by giving2children;
  • the collecting or providing of funds for any purpose other than as described in the Project published for fundraising;
  • any other activity that giving2children, at its sole discretion, considers to: (a) be unacceptable or objectionable; (b) restrict or inhibit another person from using or enjoying the Services; or (c) expose giving2children, Childhood Cancer International, its employees, or Users to any harm or liability of any kind.

Intellectual Property Rights

You acknowledge and agree that the Services may contain content or features that are protected by copyright, patent, trademark, trade secret, or other proprietary rights and laws. Unless specifically authorised by giving2children, you agree not to use, copy, modify, sell, distribute, or create similar material in whole or in part.

As a Donor, Member Organisation, or Visitor you acknowledge and agree that all assets with media character are published with consent to be used only for the purpose of giving2children, and shall not be used by you for any other purpose, as mentioned above. giving2children reserves all rights not explicitly granted in this document.

Third-Party Websites

The Services or third-parties may facilitate links, tools, or features to access other sites, resources, or services offered by third-parties. You acknowledge that giving2children is not responsible, nor held any liability, directly or indirectly, for any content, damage, loss, or services available through the third-parties. You acknowledge and agree that once accessing products or services of third-parties, new terms and conditions may be associated with the actions.

Currently, the third-party websites connected to the giving2children are: Stripe, PayPal, Mailchimp, WordPress, GoDaddy, Google Cloud Platform, Amazon Web Services, Vercel, Techsoup.

Privacy Policy

We respect the privacy of our Users. Learn how we are managing this by accessing our Privacy Policy. Note that by using the Services, you acknowledge our collection, use, and sharing of personal data as outlined therein.

Modification of Terms & Conditions

The Terms & Conditions may be modified in response to new regulations, further development, and at our sole discretion. When possible, notice of substantial changes shall be made to inform users via email or other appropriate means. Any revised version of the Terms & Conditions will be published on this page, in the English language version, indicating the date of the last update. Your continued use of the Platform after such changes occur represents the acceptance of the revised version of Terms & Conditions.
